Layer Acceptable Use Policy

This Layer Acceptable Use Policy ("Policy"), as we may amend from time to time by posting a new version on this page, supplement the Layer Terms of Service or any other agreement between you, our customer (“you”) and Layer AI, Inc. or its corporate affiliates (together, "Layer") governing the use of Layer's Platform, Services, Website or other products and services (each of the foregoing, the "Agreement"). The Policy apply to your access and use of the Services and the Customer Content (including the Input you provide us with and Generated Content based on such Input). Capitalized but undefined terms used in the Policy have the meanings set forth in your applicable Agreement with Layer.
Prohibited Activities
You and your Users will adhere to this Policy at all times. You will not use the Services in a manner, nor share with the Services any Input that, nor knowingly use the Services or Models via the Services to generate, edit or modify any Generated Content that, or use Generated Content to perform any of the following activities:
Facilitate or encourage any illegal, fraudulent, or abusive activities or materially interferes with the business or activities of Layer or harm any of its Users;
Transmit infringing, libellous, or otherwise unlawful or tortious material or malicious code
Upload to the Services, generate, use or share any materials that: (a) infringe any intellectual property or other proprietary rights of any party; (b) you do not have a right to upload, share or modify under any law or under any contractual or fiduciary relationship;
Engage in spam, including but not limited to sending of unsolicited or unauthorized messages, advertising, promotional materials, or any other form of unpermitted solicitation, including activities that violate the Controlling the Assault of Non-Solicited Pornography and Marketing (CAN-SPAM) Act.
Use the Services or Generated Content or create Generated Content that is or in a manner that is intentionally misleading, false, with the purpose of harming others, regardless of whether the Generated Content or its dissemination is unlawful;
Use the Services to produce Generated Content or share Generated Content that a reasonable person could find obscene, lewd, lascivious, offensive, pornographic, indecent, vulgar, prurient, excessively violent or to be a glorification or promotion of violence, terrorism or a celebration of the suffering or humiliation of any person or class of people (whether living or deceased);
Use the Services or Website to create or transmit any material or content that facilitates or encourages defamatory, discriminatory, or otherwise malicious or harmful speech or acts to any person or entity, including but not limited to hate speech;
Use the Services or Website to create any material or content that Layer reasonably believes degrades, intimidates, incites violence against, or encourages prejudicial action against anyone based on age, disability, ethnicity, gender, geographic location, national origin, race, religion, sexual orientation or other protected category;
Use the Services to exploit vulnerabilities of a specific group of persons based on their age, social, physical or mental characteristics, in order to materially distort the behaviour of a person pertaining to that group in a manner that causes or is likely to cause that person or another person physical or psychological harm; and/or
Use the Services for fully automated decision making that adversely impacts an individual’s legal rights or otherwise creates or modifies a binding, enforceable obligation.
If the Services generate any Generated Content which may cause to be in breach of any of the above, you will notify us in writing promptly upon becoming aware of it.
Enforcement of this Policy, including the determination whether a violation occurred, is at Layer's sole and absolute discretion, and failure to enforce it in one instance does not constitute a waiver to enforce the Policy in other instances. You will promptly cease use of any Customer Content via the Services or Generated Content violating this Policy, and Layer has the right to promptly suspend, remove or delete any violating or infringing Content from the Services in its sole discretion, or modify the Services, Platform and Website to ensure compliance with this Policy.
